El trabajo analiza uno de los principios jurídicos que rigen en materia de política hídrica, el denominado “principio de inherencia”. Brinda una aproximación en cuanto al alcance del mismo y su recepción legislativa en los diversos ordenamientos provinciales. Profundiza en el estudio de la normativa hídrica de la Provincia de Mendoza con relación a éste principio. Finalizando con un análisis crítico de las resoluciones del Departamento General de Irrigación en materia de otorgamiento de permisos de perforación de aguas subterráneas y posterior concesión de uso de agua.
This paper analysis one of the legal principles which applies to water policy, known as principle of inherence. Offering an estimate of its coverage and legislative reception in several provincial systems. It delves into the study of water regulations of the Province of Mendoza regarding this tenet. Concluding with a critical analysis of the resolutions of the General Board of Irrigation on the subject of issuing permits for groundwater boreholes and latter concession for water use.
