El presente artículo tiene por objeto analizar la regulación de los contratos bancarios en el Código Civil y Comercial de la Nación, destacando los aspectos positivos de la regulación pero por sobre todo los polémicos, puesto que conllevan el potencial de desnaturalizar la esencia misma de algunos contratos, y por ende, perjudicar abiertamente a la parte más débil del mismo (el cliente–consumidor).
This article aims to analyze the regulation of the banking contracts in the National Civil and Commercial Code, emphasizing some positive aspects of the regulation and also the most controversial ones, since the new regulation may change the essence of the contract, harming its weakest part (the client–consumer).
