Abstract

El presente trabajo pretende una aproximación inicial a la problemática de los residuos sólidos urbanos en la República Argentina. Partimos de las previsiones de la cláusula ambiental prevista en el artículo 41 de la Constitución Nacional para luego avanzar sobre las principales normas sobre residuos en la Argentina y el sistema de distribución de competencias en el sistema federal argentino. Finalmente se concluye en un análisis crítico al sistema actual y en la necesidad de un cambio.

This paper aims to analyze the problem of solid waste in Argentina. It starts with the provisions of the environmental clause in article 41 of the National Constitution, then goes on the main rules –at national and local level– for the handling waste in Argentina, and finally it concludes with a critical analysis of the current system and the need for a change.
