Abstract

This paper studies the hypothesis of a group of persons, taking part in the same criminal activity, contributing with its preparatory activities. The objective of this research is to provide a response to those problematic cases that arises according to the theory on participation in criminal activity. To do this, it is proposed the use of the principle “omissio libera in causa”, that hasn’t been explored by the doctrine to explain these cases, yet.

Professor and researcher at the Department of Criminal Law at Pompeu Fabra University. Attached to the Chair of Criminal Law of the Faculty of Law of the National University of Cuyo. PhD student at Pompeu Fabra University. Master in Legal Sciences from the Pompeu Fabra University. Master's Degree in Criminal Law and Criminal Sciences from the National University of Cuyo.
