An Introduction to the Legal Theory of John Finnis

John Mitchell Finnis is one of the leading exponents of the so–called New School of Natural Law. He was trained in analytical philosophical tradition. Later, classical authors such as Thomas Aquinas, Plato and Aristotle influenced his thought through the interpretive guidelines of Germain Grisez ethical theory. Through this theory he noted an approach to the classical texts of the theory of natural law that was immune from the positivist accusation regarding the so–called “naturalist fallacy”. He also noted an important analysis of the position of Thomas Aquinas on the evidence of the principles of practical reason. According to these authors, Thomas Aquinas understood that the first principles of practical reason, that guide all human actions towards intelligible human goods, provide reasons for action and govern the entire practical thinking.
