El propósito general de este trabajo consiste en plantear y poner a prueba la tensa relación que existe entre las ideas de algunos autores que se consideran o son considerados populistas y el rule of law. Para ello se procurará, concretamente: a) dar con algunas de las notas principales que caracterizan al populismo; b) exponer los cuestionamientos que desde posiciones próximas al populismo o populistas se han hecho hacia la idea de rule of law; c) detectar cuáles son los campos de referencia más importantes del rule of law y proponer la conveniencia e incluso necesidad de dar con un significado focal o nuclear del rule of law, e indagar cuál pueda ser ese significado; d) contraponer la versión débil de rule of law, que propone su carácter amoral, con su contrapartida, la versión fuerte o robusta.
The general purpose of this paper is to contemplate and assess the tense relation there is among ideas of some authors who consider themselves or are considered populist and the rule of law. In order to do so, what has specifically been done is: a) outline certain principles which characterize populism; b) expose questioning from views close to populism or which populists have made on the idea of rule of law; c) identify which are the most important areas of reference of the rule of law and suggest the convenience and need to achieve a nuclear definition for rule of law, and research which could it be; d) contrast the weak version of rule of law, which poses its amoral character, with its strong or robust version.
