La situación actual del poder judicial está atravesada por diversas antinomias que van desde las críticas a la legitimidad de origen (justicia legitima) y de ejercicio (justicia dialógica), hasta la desaparición de los tribunales. En este escenario, algunos autores enrolados en la llamada “justicia dialógica”, parten de un concepto de constitución denominada deliberativa, donde la legitimación constitucional estaría en un diálogo inclusivo en que las decisiones serían resultado de procesos de discusión en los que intervinieren todos los afectados en igualdad de posiciones. En segundo lugar, se observa una crítica a la supuesta falta de legitimidad de ejercicio democrático del poder judicial. El presente artículo, responderá al siguiente interrogante: ¿El poder judicial, es un órgano jurisdiccional o un promotor de la deliberación democrática? Se estudiará cuáles serían los alcances de una democracia deliberativa en el estado de derecho y su proyección al poder judicial.
The current situation of the judiciary is undergoing numerous antinomies that range from criticism to the legitimacy of origin (legitimate justice) and practice (dialogic justice), to the disappearance of courts. In this scenario, some authors enrolled in the so–called Dialogic Justice, based on the concept of deliberative constitution in which constitutional legitimation is in an inclusive dialogue in which decisions result from discussion processes in which all those affected are in the same conditions. Second, there is criticism of an alleged lack of legitimacy in democratic practice on behalf of the judiciary. This article will answer the following question: Is the judiciary a jurisdictional body or a promoter of democratic deliberation? The scope of a deliberative democracy in the rule of law and its impact on the judiciary will be studied.
