En el presente trabajo proponemos estudiar uno de los aspectos que imprime más singularidad al Convenio Europeo de Derechos Humanos: la ejecución de las sentencias del Tribunal Europeo de Derechos Humanos. Proponemos, en efecto, estudiar el proceso de ejecución de las sentencias de la Corte Europea desde una perspectiva internacional o convencional, así como desde una perspectiva nacional, es decir, proponemos, por una parte, examinar el proceso de ejecución de sentencias a la luz del art. 46 del Convenio, con especial enfoque en la labor de control de ejecución de sentencias por el Comité de Ministros, y, por otra parte, analizar las soluciones que ofrecen algunos ordenamientos jurídicos de Estados miembros de recepción de las sentencias del Tribunal.
This paper examines one of the aspects that gives more expression to the European Convention on Human Rights: the execution of judgments of the European Court of Human Rights. We intend to study the process of execution of European Court judgments from an international or conventional perspective, as well as from a national perspective. On the one hand, we propose to examine the process of execution of judgments in the light of art. 46 of the Convention, with a special focus on the supervising role of the Committee of Ministers and, secondly, we will analyse the domestic legal solutions offered by some Member States in order to implement the judgments handed down by the Court.
