Los debates sobre las decisiones de los tribunales regionales de derechos humanos y las obligaciones que asumen los Estados de cumplirlas sin objeciones, vienen mostrando diversas situaciones en la región americana. En particular, cuando se trata de dejar sin efecto decisiones del máximo tribunal de un país, la controversia es aún mayor por tratarse de un órgano independiente del Estado y donde los otros poderes no pueden ordenar modificar sus decisiones. En el caso de estas reflexiones, se analiza la decisión de la Corte Suprema de Justicia de Argentina, ante la negativa de hacer efectiva una resolución de la Corte Interamericana de Derechos Humanos.
The debates on the decisions of the regional courts of human rights and the obligations that the States assume to comply them without objections, have been showing diverse situations in the American region. Specifically, when it comes to nullifying decisions of the highest court of a country, the controversy is even greater because it is an independent body of the State and where the other powers cannot order modify their decisions. In the case of these reflections, the decision of the Supreme Court of Justice of Argentina is analyzed, given the refusal to enforce a resolution of the Inter–American Court of Human Rights.
