Eficacia jurídica de las decisiones judiciales de la Corte Interamericana de Derechos Humanos en México / Legal Effectiveness of the Judicial Decisions of the Inter-American Court of Human Rights in Mexico

Abstract

Las decisiones judiciales de la Corte Interamericana de Derechos Humanos impactan en el ordenamiento jurídico de los Estados al establecer medidas de reparación que inciden, a través de reformas constitucionales, reformas a leyes secundarias y el establecimiento de diversas figuras jurídicas en aras de proteger derechos humanos. Este artículo analiza diversas decisiones judiciales de este tribunal, emitidas en contra de México y las consecuencias que tuvieron en el Estado derivadas de la implementación y que logran una armonización entre los estándares internacionales de protección de derechos humanos y el derecho doméstico del Estado. 

The judicial decisions of the Inter-American Court of Human Rights have an impact on the legal system of the States when establishing reparation measures that affect through constitutional reforms, reforms to secondary laws and the establishment of various legal entities in order to protect human rights. This article analyzes several judicial decisions of this court issued against Mexico and the consequences they had in the State derived from the implementation and that achieve a harmonization between international standards of protection of human rights and domestic law of the State.
