La Corte Interamericana de Derechos Humanos dentro de su función jurisdiccional está facultada para emitir resoluciones a los Estados parte de la Convención Americana sobre Derechos Humanos, en adelante la CADH, ante la existencia de violaciones de los derechos humanos consagrados en el instrumento internacional citado. Estas sentencias son de carácter obligatorio; no obstante, tienen alcances y efectos sui generis; así como modalidades de cumplimiento y medios para su supervisión y ejecución de naturaleza distinta a las sentencias domésticas, aspectos que serán desmembrados para su análisis en las líneas del presente ensayo, con énfasis en el caso mexicano.
The Inter–American Court of Human Rights within its jurisdictional function is empowered to issue resolutions to the States parties of the American Convention on Human Rights, from now on the ACHR, given the existence of violations of human rights consecrated in the mentioned international instrument, these sentences are mandatory; however, they have sui generis scope and effects; as well as compliance modalities and means for their supervision and enforcement of a nature other than domestic judgments, aspects that will be dismembered for analysis in the lines of this essay, with emphasis on the Mexican case.
