El propósito de la comunicación será desarrollar los alcances de la jurisprudencia de la Corte Interamericana de Derechos Humanos en el sistema de justicia constitucional costarricense. En este orden, la Sala Constitucional costarricense ha sostenido que es vinculante para todos los órganos jurisdiccionales, en el ejercicio del control de convencionalidad (ver sentencia No. 2014–12703). De igual modo, los tribunales ordinarios también han inaplicado leyes por motivos de inconvencionalidad. Por lo anterior, es preciso preguntarse si ello supone una ruptura del sistema de justicia constitucional concentrado que disfrutaba la Sala Constitucional.
The purpose of communication is to develop the scope of the jurisprudence of the Inter–American Court of Human Rights in Costa–Rican Constitutional justice system. In this order, the Costa–Rican Constitutional Court has held that it is binding on all courts in the exercise of control of compliance (see Judgment No. 2014–12703). Similarly, the courts have also rendered inapplicable laws because of unconventionality. Therefore, one must ask if this is a breach of constitutional justice system focused enjoyed by the Constitutional Court.
