El Nuevo Código Civil y Comercial de la Nación (CCyCN) tiene nuevos paradigmas que implican una necesaria elasticidad de las normas jurídicas, obliga a los destinatarios a realizar una integración armónica del ordenamiento jurídico. Este código contempla una serie de preceptos que, en materia de responsabilidad civil médica, posibilitan que tanto los profesionales de la salud como las instituciones de dicho servicio tomen recaudos indispensables para evitar incurrir en una mala praxis. Por su parte, la incorporación de la novel doctrina de las cargas probatorias dinámicas al CCyCN con fundamento constitucional, junto a otras disposiciones, convierte al apartado jurisdiccional en uno de los principales receptores del nuevo código. La nueva estructura legal no limita su aplicación a una mala praxis médica, sino que faculta al juez a hacer uso de esta facultad dependiendo del caso en concreto: distribuyendo la prueba de la culpa o de haber actuado con diligencia debida, ponderando la mejor situación para aportarla.
The New Civil and Commercial Code of the Nation (CCyCN) has new paradigms that imply a necessary elasticity of the legal norms, forcing the addressees to conduct a harmonious integration of the legal system. This code considers a series of precepts that, in terms of medical civil liability, enable both health professionals and institutions of aforementioned service to take required precautions to avoid incurring in malpractice. On its behalf, the incorporation of the new doctrine of dynamic evidentiary burdens in the CCyCN with constitutional grounds, together with other regulations, transforms the jurisdictional section into one of the main recipients of the new code. The new legal structure does not limit its application to medical malpractice, but it empowers the judge to make use of this power depending on the specific case: distributing proof of fault or having acted with due diligence, analyzing the best situation to provide for it.
