“Marcas muertas”. El aprovechamiento de prestigio ajeno / “Dead Brands”. Exploiting the Prestige of Others

Si bien las marcas registradas pueden caer en desuso y ser declaradas caducas –permitiendo que cualquier persona o compañía pueda registrarlas bajo su nombre–, el presente trabajo analiza la hipótesis desde la óptica de las marcas notorias caducas, y el aprovechamiento de tal situación para explotar el prestigio ajeno, en probable burla a las reglas de competencia leal.
Even though registered trademarks may become obsolete and declared invalid –allowing any person or company to register them under their name–, this paper analyzes the supposition of expired well–known brands, and the exploitation of this situation so as to take advantage of the prestige of others, in likely mockery of the rules of fair competition.
