Las políticas sociales de juventudes y los derechos humanos: entre el decisionismo político y las obligaciones estatales / Youths’ Social Policies and Human Rights: Between Political Decisionism and State Obligations

El objetivo del artículo es señalar la diferencia en la concepción de las políticas sociales –incluidas las de juventudes– desde la incorporación del enfoque de derechos humanos y a partir de ello los límites que colocan al decisionismo político. En tal sentido se presentan el conjunto de estándares en materia de derechos sociales cuya incorporación en los programas sociales garantiza el cumplimiento de tales derechos. Asimismo se agregan las particularidades propias de las intervenciones sociales dirigidas al colectivo juvenil. A modo ilustrativo se describe el caso del Programa de Respaldo a Estudiantes Argentinos (PROGRESAR) –en tanto política dirigida a las juventudes– y el modo en que se presentan los principios del derecho internacional de los derechos sociales en dicha política. Para ello se tienen en cuenta los documentos oficiales que regulan al programa.
The aim of this article is to point out the difference in the concept of social policies –including those of youths– since the inclusion of the human rights’ approach and hitherto the limits imposed on political decisionism. This is how the set of standards on social rights is presented whose incorporation in social programs guarantees the fulfillmen of these rights. Also including the peculiarities of social interventions addressed to the youth group. As an example, the case of Programa de Respaldo a Estudiantes Argentinos (PROGRESAR) is described as a policy directed at youth and the way in which the principles of international social rights law are presented in this policy. The official documents that regulate the program are taken into account.
